Terms of Service
These Terms of Service (the “Terms”) govern your access to and use of the tojcampaign.com website and any related services, content, and deliverables (collectively, the “Services”) provided by Trail of Joy Management Group, LLC (“TOJ,” “we,” “us,” or “our”). By accessing the Services, you agree to these Terms.
1. Who we are
Trail of Joy Management Group, LLC is a for-profit limited liability company. TOJ provides consultancy, education, and (beginning August 2026) software-as-a-service products under three verticals: Personal Brand, Non-profit, and Authority. Nothing on this website constitutes an offer to sell securities.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to use the Services. If you are engaging TOJ on behalf of an organization, you represent that you have authority to bind that organization.
3. Services and deliverables
Foundation Score™ and Operational Transcript™
When you complete a Foundation Score™ intake, TOJ will deliver a written Operational Transcript™ within 72 business hours, unless a different timeline is expressly agreed. The Operational Transcript is a professional assessment of your operation across the five pillars. It is not a substitute for licensed legal, financial, medical, or tax advice.
Engagements
Consultancy and platform engagements are governed by a separate Master Services Agreement (MSA) or Statement of Work (SOW) executed between TOJ and the client. Terms in an executed MSA or SOW take precedence over these Terms where they conflict.
SaaS product
Access to TOJ’s software platform (launching August 2026) will be governed by a separate Subscription Agreement referenced at signup. Waitlist signup is not an offer or contract to provide the SaaS product.
4. Payment and refunds
Fees, payment schedules, and refund terms are specified in the applicable MSA, SOW, or Subscription Agreement. Absent that, any deposits paid for services are non-refundable once work has commenced. Chargebacks initiated without first attempting good-faith resolution with TOJ constitute a material breach.
5. Intellectual property
Our marks
Trail of Joy®, TOJ Campaign™, Foundation Score™, and Operational Transcript™ are marks of Trail of Joy Management Group, LLC. Nothing on this site grants any license to use those marks without prior written consent.
Client materials
Client materials submitted to TOJ (including intake responses, brand assets, and operational data) remain the property of the client. By submitting them, you grant TOJ a non-exclusive license to use, process, and reference them for the sole purpose of delivering the Services.
TOJ deliverables
Frameworks, methodologies, templates, and platform code developed by TOJ remain TOJ’s property. Client-specific outputs (the Operational Transcript itself, a client-branded playbook, a client-installed workflow) are licensed to the client for use within their business.
6. Confidentiality
TOJ treats client materials submitted through intake or engagement as confidential. Redacted, aggregated, or anonymized excerpts may be used for network-wide pattern research, sample transcripts, and public case studies only with prior written consent or with all identifying information removed.
7. Warranties and disclaimers
TOJ will perform the Services with professional care and skill. Beyond that:
- The Services are provided “as is” and “as available.”
- TOJ makes no guarantee of specific business results, revenue outcomes, athletic outcomes, grant awards, or credibility gains.
- The Operational Transcript reflects TOJ’s professional assessment at the time of delivery. Business conditions change; the assessment is not a permanent statement of fact.
8. Limitation of liability
To the maximum extent permitted by law, TOJ’s aggregate liability arising out of or related to these Terms, any engagement, or any use of the Services is limited to the amount you have paid TOJ in the twelve (12) months preceding the claim. TOJ is not liable for indirect, consequential, incidental, special, or punitive damages, including lost profits or lost business opportunities.
9. Indemnification
You will indemnify and hold harmless TOJ, its principals, employees, and contractors from any third-party claim arising out of your breach of these Terms, your unlawful use of the Services, or your infringement of any third party’s rights.
10. Termination
TOJ may suspend or terminate your access to the Services at any time for breach of these Terms or for conduct that TOJ reasonably believes is fraudulent, abusive, or harmful. Sections that by their nature survive termination (IP, confidentiality, liability, indemnification, dispute resolution) do so.
11. Governing law and disputes
These Terms are governed by the laws of the State of [state to be confirmed by counsel], without regard to conflict-of-laws principles. Any dispute arising out of or related to these Terms will be resolved in the state or federal courts located in [venue to be confirmed by counsel], and you consent to the exclusive jurisdiction of those courts.
12. Changes to these Terms
TOJ may update these Terms from time to time. Material changes will be noted with an updated “Last updated” date. Continued use of the Services after an update constitutes acceptance of the revised Terms.
